I, Shari Kavalin, operating as Elegant Escapes, LLC. (“Agency”), am pleased to provide you with travel planning services. Before we begin working together, it is important that you read and agree to the following terms and conditions.
Services Provided Elegant Escapes, LLC is a travel agency that facilitates the booking of travel-related services, including but not limited to flights, accommodations, transportation, tours, and activities ("Services"). The Company acts as an intermediary between you and third-party service providers (e.g., airlines, hotels, car rental companies), and we are not responsible for the provision of these services. We shall not be liable for any errors, omissions, acts, or failures of third-party service providers.
Service and Retainer Fee
By engaging my services, you acknowledge that the Agency's fee is for planning and consultation services only and is separate from the actual cost of travel. The retainer fee compensates me for the time spent researching the best options, negotiating favorable terms, and providing competitive pricing to create a personalized itinerary for you. This fee is non-refundable and is due prior to commencing any work on your trip.
Retainer Fee Commitment: The retainer fee also signifies your commitment to booking your travel itinerary with Elegant Escapes, LLC. If you choose not to travel or decide to book the itinerary independently, the retainer fee will be considered compensation for the time invested in working on your behalf. Review and Approval: You will have the opportunity to review and approve the proposed itinerary, associated pricing, and the terms and conditions of the travel supplier before any reservations are made on your behalf. Upon concluding our initial consultation, the retainer fee of $500 is due before planning for your trip commences.
Fee Structure Initial Retainer/Research Fee: $500.00 Full Cancellation Fee (applies after entire trip is planned and confirmed but prior to travel): $100.00 per cabin or reservation (in addition to any supplier fees) Additional fees may apply for special concierge services, which will be discussed and agreed upon between you and Elegant Escapes, LLC. These may include, but are not limited to:
Large Group Planning (more than 10 travelers): $1,000.00
Expedited Service (for travel to take place within 7 days): $400.00
International Airline Ticketing: $50.00 per person
International Business/First Class Airline Ticketing: $100.00 per person
Assistance with Booking Flights using Points and Miles: $100 per household
Hotel Reservation with no other services purchased: $50.00
Bookings and Payments All bookings made through Elegant Escapes are subject to availability. By making a booking, you confirm that you are at least 18 years old and possess the legal authority to enter into a binding contract. Prices displayed on our website or provided through our agents are subject to change without notice until payment is received and confirmed. Payment for bookings must be made in full at the time of reservation, unless stated otherwise in writing by Elegant Escapes. Elegant Escapes reserves the right to cancel any booking if payment is not received within the specified timeframe.
Review Your Travel Documents Immediately Once tickets and confirmations have been issued, it is your responsibility to review and inform us of any errors. Suppliers may have penalties for modifications or refunds. We do not have control over printed prices on the tickets, although some tickets may have BT (Bulk fare) printed on them, and some may have a specific value on them, which may be different (lower or higher) than the fare collected.
Credit Card Authorization By submitting a credit card authorization form to Elegant Escapes, LLC., you grant permission for us to use your payment method to purchase travel products from our suppliers on your behalf.
Disputes and Chargebacks You agree not to file any dispute with your bank or credit card company to evade or violate any booking terms and conditions of Elegant Escapes, LLC. or its suppliers, including cancellations or changes of itinerary or arrangements for reasons beyond the control of Elegant Escapes, LLC. or its suppliers. In the event that you attempt to charge back, reverse, or recollect a previously authorized trip payment, Elegant Escapes, LLC. reserves the right to collect all additional costs, fees, and expenses associated with such chargeback, reversal, or recollection, including attorney fees.
Cancellations, Modifications, and Refunds
Cancellation and modification policies vary by service provider and are subject to their terms and conditions. Elegant Escapes will inform you of the applicable policies at the time of booking. In addition to supplier rules, any reservation that is booked and later cancelled will incur a $200 cancellation fee per booking. All fees paid to Elegant Escapes, including the retainer, research fee, planning fees, and cancellation fees, are non-refundable.
Requests for cancellations or modifications must be submitted in writing to Elegant Escapes and are subject to the approval of the respective service provider. Refunds, if applicable, will be processed according to the terms and conditions of the service provider. Elegant Escapes shall not be liable for any delay or failure in the processing of refunds by the service provider.
Travel Documentation and Requirements
It is your responsibility to ensure that you possess the necessary travel documents, including passports, visas, and health certificates, as required by the destination country and transit countries. Elegant Escapes shall not be held liable for any costs, damages, or losses incurred due to the failure to comply with travel documentation requirements. Visa and Passport requirements are the sole responsibility of the passenger(s) traveling. Passports must be in excellent condition; otherwise, boarding will be denied by the airline and/or the immigration officer. U.S. citizens traveling to any destination outside of the United States will be required to present a valid U.S. passport. Passports must be valid for up to 6 months AFTER the return date. Some countries require a visa or proof of vaccination for transit or entry.
Review this with your travel advisor prior to the start of the planning process. These terms may change at any time, so review them again before your departure. Make sure your passport has at least two empty pages.
The only exception to the "Passport Rule" is when traveling on a "Closed Loop Cruise" that starts and ends in the same US Port where alternate travel documentation will be accepted for boarding the cruise. The U.S. Customs and Border Protection states: "U.S. citizens on closed-loop cruises (cruises that begin and end at the SAME U.S. port) will be able to board the ship and enter or depart the country with a birth certificate and government-issued photo ID with matching names."

Please be advised that should you need to return from an international destination WITHOUT a valid US Passport, that may present separate issues that you agree to be solely responsible for. All names on travel documents must match the legal name on your photo I.D., and travel document information must match tickets. Please check the State Department website for further information about these requirements at https://travel.state.gov.
Children and infants also require travel documents. Minors traveling with one parent and/or without both parents may be stopped and not admitted unless authenticated and verified consent forms are provided to the authorities; please see Children - Child traveling with one parent or someone who is not a parent or legal guardian or a group (cbp.gov) for additional information.
Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. Passengers are responsible to ensure that they have all the proper documents for entry. We do not inquire about an individual’s criminal record in the interest of respecting our Clients' privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record should review current entry requirements. Check with the nearest consulate or embassy of the destination you are traveling to and find out the entry requirements for non-U.S. citizens.
Travel Insurance Elegant Escapes, LLC strongly recommends the use of Travel Protection Insurance. We will provide you with an insurance quote, and should you wish to travel without coverage, we will require you to sign an affidavit stating that you have rejected the offer of coverage and have made the decision to travel uninsured. It is your responsibility to understand the coverage and terms of the travel insurance policy you choose.
Limitation of Liability Elegant Escapes shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of our Services. In no event shall Elegant Escapes' total liability to you for all claims, damages, losses, or causes of action exceed the amount paid by you for the specific service giving rise to the claim. Please note that as a travel advisor, Elegant Escapes, LLC. acts solely as an agent for suppliers of travel and other services. Elegant Escapes, LLC. bears no responsibility for any cancellation of services by the supplier, changes or modifications by the supplier or the destination of itineraries, air carrier, routing, scheduling, departure date, level of service, fluctuation in fares, rates, surcharges, and/or price differentials. Elegant Escapes, LLC. is not liable for any claims, losses, damages, costs, expenses, delays, or loss of enjoyment, of any nature or kind whatsoever resulting from events beyond its or a supplier's reasonable control, including but not limited to acts of God, strikes, lockouts, or other labor disputes or disruptions, wars, blockades, insurrections, riots, earthquakes, weather conditions, floods, or acts or restraints imposed by government authorities.
Indemnification You agree to indemnify and hold Elegant Escapes, its officers, directors, employees, and agents harmless from any claims, demands, losses, liabilities, and expenses (including legal fees) arising out of or in connection with your use of our Services or any breach of this Agreement.
Intellectual Property All intellectual property rights related to Elegant Escapes' website, content, and materials are owned by or licensed to the Company. You agree not to reproduce, distribute, modify, or use any of our intellectual property without prior written consent.
Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Elegant Escapes is registered. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in the same jurisdiction.
Miscellaneous
Special hotel requests such as bed types, smoking preference, and connecting rooms are subject to availability. Room selection in all cases, unless otherwise reserved, is strictly at the discretion of the hotel's management on a run-of-house basis. Although most 4- and 5-star hotels have rooms that feature their own individual climate control, the use of air-conditioning abroad differs greatly from the United States and is sometimes shut down at night. It may also not be widely in use from the end of summer until the beginning of the next summer season. Some lodges and accommodations in remote regions may not have all the amenities, such as a hairdryer, alarm clock, and room service, that you might find in a larger hotel located in a city center.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. Elegant Escapes may modify or update these Terms and Conditions at any time without prior notice. It is your responsibility to review this Agreement periodically for any changes.

By proceeding to use the services of Elegant Escapes, LLC., you indicate your understanding of and agreement to these terms and conditions.
